This includes, but is not limited to, damages for loss of profits, goodwill, use data, or other intangible losses (even if Local Jackpots LLC has been advised of the possibility of such damage). These damages may arise from the use or the inability to use the Platform or any Services available through it; the cost of procurement of substitute goods and services resulting from goods, data, information, or services purchased or obtained or messages received or transactions or data; statements or conduct of any third party on the platform; or any other matter relating to the Platform or any services available through it.
Indemnification
You agree to indemnify and hold Local Jackpots LLC, its affiliates, officers, directors, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of or in connection with your use of our services or violation of these Terms.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the district in which Local Jackpots LLC. operates. Any disputes arising out of or in connection with these terms shall be resolved through arbitration in accordance with the rules of the relevant arbitration authority.
Modifications to Terms
Local Jackpots LLC. reserves the right to modify or update these terms at any time without prior notice. It is your responsibility to review these terms periodically for any changes. Your continued use of our services after any modifications to these terms constitutes your acceptance of the revised terms.
Sever-ability
If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between you and Local Jackpots LLC. regarding the use of our services and supersede any prior agreements or understandings.
Privacy
The handling of your personal information is addressed in the platform’s Privacy Policy, which is integrated into these Terms. Through your use of the Platform, you signify your agreement to the terms laid out in the Privacy Policy.
Proprietary Rights
It is understood and acknowledged that the platform and any necessary software used in connection with it contain proprietary and confidential information owned or licensed by Local Jackpots LLC and its licensors. You further recognize and accept that content presented through sponsor advertisements or information provided by advertisers on the Platform is safeguarded by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. Except as expressly permitted by Local Jackpots LLC or advertisers, you are prohibited from altering, renting, leasing, loaning, selling, distributing, or creating derivative works based on the Platform or the services, in whole or in part.
Disclaimer of Warranties
The Platform and the Services available through it are provided on an “as is” and “as available” basis. Local Jackpots LLC expressly denies all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Local Jackpots LLC makes no warranty that the platform or the services available through the platform will be uninterrupted, timely, secure, or error free. Furthermore, Local Jackpots LLC does not warrant the accuracy or reliability of the results obtained from the use of the Platform or any Services available through it. Local Jackpots LLC does not guarantee the accuracy or reliability of any goods or services purchased or obtained through the Platform or any transactions entered via the Platform. Dispute Resolution
Dispute Resolution Process
If you’re dissatisfied with our Services for any reason, please contact Local Jackpots Customer Service first so we can attempt to address your concerns without the need for outside assistance. Should you opt to pursue a dispute, claim, or controversy against Local Jackpots, these terms will apply. For the purposes of this Dispute Resolution Process and Arbitration Procedures outlined in Section 14, “Local Jackpots” shall encompass our affiliates, employees, licensors, and service providers.
Local Jackpots highly values its relationship with you and recognizes the mutual benefits gained from informally resolving Disputes. For the purpose of this Agreement, a “Dispute” refers to any disagreement, claim, or controversy between you and Local Jackpots arising from or related to this Agreement (including any alleged breaches), the Service, or our association with you. The term “Dispute” as used herein is to be interpreted broadly and encompasses claims that arose prior to the existence of this or any prior Agreement, as well as those arising during or after the term of this Agreement (unless superseded by a subsequent Agreement between you and Local Jackpots).
Should you have a Dispute with Local Jackpots (“Your Dispute”), before formally pursuing it through arbitration or small claims court, you agree to send a comprehensive notice (“Notice”) to support@localjackpots.com. However, if Your Dispute involves individual claims of sexual assault or sexual harassment associated with your use of the Services, you are not obligated to send a Notice before pursuing your claims as outlined in Section 14.
In the event Local Jackpots has a Dispute with you (“Local Jackpots’ Dispute”), Local Jackpots undertakes to send a Notice to your most recent email address on record with us, or if unavailable, other contact information associated with your account. Your Notice must include: (1) your full name; (2) details enabling Local Jackpots to identify your account, such as a picture or screenshot of your profile, your address, mobile phone number, email address, and date of birth used for account registration, if applicable; and (3) a comprehensive description of your Dispute, including the nature and factual basis of your claim(s) and the relief sought, along with a corresponding calculation of alleged damages, if applicable. Personal signature is required for the Notice to be effective. Local Jackpots’ Dispute Notice must similarly provide a detailed description of Local Jackpots’ Dispute, including the nature and factual basis of its claim(s), sought relief, and a corresponding calculation of damages, if any.
You and Local Jackpots agree to engage in good faith negotiations to resolve the Dispute. As part of this process, Local Jackpots may request a telephone conference with you to discuss Your Dispute, and you agree to participate personally, with your legal representative if applicable. Similarly, you may request a telephone conference to discuss Local Jackpots’ Dispute with you, and Local Jackpots agrees to have one representative participate. (For clarity,
Local Jackpots’ termination of your account, as outlined in Section 4 above, does not constitute Local Jackpots’ Dispute with you.)
This informal process is expected to lead to Dispute resolution. However, if the Dispute remains unresolved within 60 days after receiving a fully completed Notice and the Parties have not mutually agreed to extend this informal resolution period, either you or Local Jackpots may initiate arbitration (subject to a Party’s right to choose small claims court as provided below).
Prior to initiating any arbitration demand or small claims court action (excluding individual claims of sexual assault or sexual harassment linked to your use of the Services), the completion of this informal dispute resolution process is a prerequisite. Failure to do so constitutes a breach of this Agreement. While you and Local Jackpots are engaged in this informal dispute resolution process, the statute of limitations and any filing fee deadlines will be paused. Unless prohibited by applicable law, the arbitration provider, National Arbitration and Mediation (“NAM”), will not entertain or administer any arbitration demand and will administratively close any arbitration unless the Party initiating the demand certifies in writing that the terms and conditions of this informal dispute resolution process were fully met. A court of competent jurisdiction is empowered to enforce this provision and to prohibit any arbitration proceeding or small claims court action accordingly.
All offers, assurances, conduct, and statements made during the informal dispute resolution process by any party, its agents, employees, and attorneys are confidential and not admissible for any purpose in any subsequent proceeding (except to the extent necessary to certify in writing that the Party fulfilled the requirements of this informal dispute resolution process before commencing a NAM arbitration). However, evidence otherwise admissible or discoverable shall not be rendered inadmissible or non-discoverable.
Class Action and Jury Trial Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND LOCAL JACKPOTS EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO LITIGATE DISPUTES IN COURT IN FAVOR OF INDIVIDUAL ARBITRATION (EXCEPT FOR SMALL CLAIMS COURT OR FOR INDIVIDUAL CLAIMS OF SEXUAL ASSAULT OR SEXUAL HARASSMENT OCCURRING IN CONNECTION WITH YOUR USE OF THE SERVICES, AS PROVIDED HEREIN). YOU AND LOCAL JACKPOTS EACH WAIVE THE RIGHT TO FILE OR PARTICIPATE IN A CLASS ACTION AGAINST THE OTHER OR OTHERWISE TO SEEK RELIEF ON A CLASS BASIS, INCLUDING ANY CURRENTLY PENDING ACTIONS AGAINST LOCAL JACKPOTS. TO THE FULLEST EXTENT PERMITTED BY LAW, THERE SHALL BE NO RIGHT OR AUTHORITY FOR ANY CLAIMS TO BE ARBITRATED OR LITIGATED ON A CLASS, COLLECTIVE, REPRESENTATIVE, CONSOLIDATED, OR PRIVATE ATTORNEY GENERAL BASIS. THE ARBITRATOR CAN AWARD THE SAME RELIEF AVAILABLE IN COURT PROVIDED THAT THE ARBITRATOR MAY ONLY AWARD FINAL RELIEF (INCLUDING INJUNCTIVE OR DECLARATORY RELIEF) IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE FINAL RELIEF WARRANTED BY THAT INDIVIDUAL PARTY’S CLAIM. THE ARBITRATOR MAY NOT AWARD FINAL RELIEF FOR, AGAINST, OR ON BEHALF OF ANYONE WHO IS NOT A PARTY TO THE ARBITRATION ON A CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL BASIS. IF A COURT DETERMINES THAT ANY OF THESE PROHIBITIONS IN THIS PARAGRAPH ARE UNENFORCEABLE AS TO A PARTICULAR CLAIM OR REQUEST FOR RELIEF (SUCH AS A REQUEST FOR PUBLIC INJUNCTIVE RELIEF), AND ALL APPEALS OF THAT DECISION ARE AFFIRMED AND SUCH DECISION BECOMES FINAL, THEN YOU AND LOCAL JACKPOTS AGREE THAT THAT PARTICULAR CLAIM OR REQUEST FOR RELIEF SHALL PROCEED IN COURT BUT SHALL BE STAYED PENDING INDIVIDUAL ARBITRATION OF THE REMAINING CLAIMS FOR RELIEF THAT YOU HAVE BROUGHT. IF THIS SPECIFIC PARAGRAPH IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRETY OF THIS ARBITRATION PROVISION (EXCEPT FOR THE JURY TRIAL WAIVER AND THE INFORMAL DISPUTE RESOLUTION PROCESS) SHALL BE NULL AND VOID. THIS PARAGRAPH IS AN ESSENTIAL PART OF THIS ARBITRATION AGREEMENT
Dispute Resolution through Arbitration or Small Claims Court
Any Dispute (that remains unresolved after attempting resolution through Local Jackpots Customer Service or as outlined above) shall be exclusively settled through BINDING INDIVIDUAL ARBITRATION, except as explicitly provided otherwise in this Dispute Resolution Section. Nonetheless, either you or Local Jackpots may opt to have an individual claim adjudicated in small claims court, and individual claims of sexual assault or sexual harassment arising from your use of the Services may be pursued in accordance with Section 14. Should a request to proceed in small claims court be made subsequent to the initiation of arbitration but prior to the appointment of an arbitrator, the arbitration shall be administratively closed by the arbitration provider (e.g., NAM). Any dispute regarding the small claims court’s jurisdiction shall be exclusively resolved by said small claims court. Decisions rendered by a small claims court shall not have binding effect in any proceedings involving Local Jackpots and any party other than you. In the event that a small claims court specifically determines its lack of jurisdiction to hear the Dispute, you and Local Jackpots shall arbitrate the Dispute in accordance with the terms of this Agreement. All other matters (unless stated otherwise herein) are exclusively within the purview of the Arbitrator to decide, including, but not limited to, the scope and enforceability of this Dispute Resolution Section, questions of arbitrability, any subsequent request to proceed in small claims court following the appointment of an arbitrator, and any disputes pertaining to whether either Party is in breach or default of the Dispute Resolution Section or has explicitly or implicitly waived the right to arbitrate. If you or Local Jackpots contests the small claims court election in your Dispute, and a court of competent jurisdiction determines the unenforceability of the small claims court election, such election shall be severed from this Agreement concerning your Dispute. However, this court determination shall not be considered or deemed binding or have preclusive effect in relation to any proceedings involving Local Jackpots and any party other than you.
Any court proceeding to enforce this Dispute Resolution Section 13, including any proceeding to confirm, modify, or vacate an arbitration award, must be commenced in accordance with Section 13. In the event Dispute Resolution Section 13 is for any reason held to be unenforceable, any litigation against Local Jackpots (except for small claims court actions) may be commenced only in the federal or state courts located in San Diego County, California. You hereby irrevocably consent to those courts’ exercise of personal jurisdiction over you for such purposes and waive any claim that such courts constitute an inconvenient forum.
Governing Law
Any claims arising from or related to these terms or the Service will be subject to California law, excluding California’s conflict of laws principles, and will be exclusively heard in the federal or state courts of California, USA. Both you and Local Jackpots LLC agree to submit to the jurisdiction of these courts.
Limitation on Legal Action
You and Local Jackpots agree that any legal action related to the services must be initiated within one (1) year from when the cause of action arises. Failure to do so will result in the permanent forfeiture of the right to pursue such legal action.
Available Jackpots Posting Terms and Conditions
Local Jackpots LLC (“Local Jackpots,” “we,” “us,” or “our”) has established the following rules governing the posting of available jackpots within our Platform. This section applies to all users (“User,” “you,” or “your”) participating in the available jackpots feature. By using this feature, you agree to adhere to these rules and understand that any violations may result in disqualification from contests, exclusion from future opportunities, or a permanent ban from our platform.
14.1 No Duplicate Entries
To maintain fairness and ensure the quality of jackpot postings, duplicates will not be counted toward any contest or prize. The following guidelines apply to avoid duplicate entries:
- Single Entry per Jackpot, per Hour: Users may post only one picture per available jackpot, per hour. Multiple posts of the same jackpot within the same hour by the same user will not count as separate entries.
- Duplicate Monitoring: Our team monitors all entries to identify duplicate posts. Any detected duplicate entries within the specified time frame will be disqualified from consideration.
14.2 Posting Requirements for Available Jackpots
To ensure the authenticity and accuracy of available jackpots, all posts must adhere to the following requirements:
- Clear Image of the Machine: The post must include a clear picture of the slot machine or gaming device displaying the jackpot. The image should show the jackpot amount in a way that is legible and visible to others.
- Clear Jackpot Display: The posted image must visibly display the jackpot amount, ensuring clarity for all viewers.
- In-Casino Posting Requirement: All available jackpots must be posted directly from the casino or gaming establishment. It is strictly prohibited to post images of jackpots from outside the casino premises.
14.3 GeoMap Activation Requirement
To confirm the validity of the posted jackpot, users must have location services activated while posting:
- Location Verification: The GeoMap feature must be activated on your device to verify that the post is being made from within the casino. Posts without GeoMap verification will be deemed invalid and may be removed.
Location Confirmation: Users acknowledge that their device’s location data will be used to confirm they are within the casino when posting available jackpots. This is necessary to maintain a fair environment for all participants.
14.4 Fraud Prevention and Honesty Requirement
Local Jackpots is committed to upholding the integrity of our contests and platform. Any fraudulent behavior or misrepresentation will not be tolerated:
- No Fraudulent Posts: Any attempt to post inaccurate or misleading information about available jackpots will result in immediate disqualification from all active contests. Fraudulent posts will also result in a permanent ban from our platform.
- Honesty in Posting: Users must post available jackpots honestly and accurately. Any attempt to manipulate, alter, or fabricate jackpot information is strictly prohibited.
14.5 Consequences of Violations
Violations of these Terms and Conditions will result in actions designed to protect the integrity of Local Jackpots’ contests:
Disqualification from Contests: Users who violate these guidelines may be disqualified from current and future contests without notice.
- Platform Ban: Users found engaging in fraudulent behavior, including posting inaccurate information or attempting to circumvent our GeoMap verification, will be permanently banned from using Local Jackpots.
14.6 Acceptance of Terms
By posting available jackpots on Local Jackpots, you agree to comply fully with these Terms and Conditions. Failure to adhere to these rules may result in forfeiture of contest entries, removal of content, or permanent account suspension.
